Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Scholarova, provided by Scholarova Ltd (“Scholarova”, “we”, “us”) at www.scholarova.com (the “Service”). By creating an account or using the Service, you agree to these Terms.

1. Eligibility and accounts
You must provide accurate registration information. You are responsible for activity under your account and for keeping credentials confidential. If you use Scholarova on behalf of a school or organisation, you confirm you have authority to accept these Terms for that use where applicable.
2. The Service
Scholarova provides tools for teaching and learning, including activities, assignments, courses, progress features, and optional integrations (such as Google Classroom). We may add, change, or withdraw features; we do not guarantee uninterrupted or error-free operation.
3. Acceptable use
You agree not to:
- Violate law or third-party rights, or upload unlawful, harmful, or infringing content
- Attempt to gain unauthorised access to systems, data, or other users’ accounts
- Interfere with or disrupt the Service, including by introducing malware
- Scrape, reverse engineer, or bypass security or rate limits, except where applicable law forbids this restriction
- Use the Service to cheat on assessments in breach of your institution’s rules
We may suspend or terminate access if we reasonably believe you have breached these Terms or create risk or legal exposure for us or others.
4. User content
You retain rights in content you submit (“User Content”). You grant Scholarova a non-exclusive, worldwide licence to host, store, reproduce, display, and process User Content solely to operate, improve, and secure the Service (including AI-assisted features you choose to use).
You are responsible for User Content and for obtaining necessary rights, consents, and licences. We may remove content that violates law or these Terms.
5. Google services
If you use Google Sign-In or connect Google Classroom, your use is also subject to Google’s terms and policies. Teachers are responsible for ensuring they have authority to link classes, import rosters, publish coursework, and sync grades in line with school policies and applicable law.
6. AI-assisted features
Where available, AI features use one or more third-party providers and may change over time. Outputs may be inaccurate or incomplete. AI output is not professional advice. You are responsible for reviewing and validating results before relying on them.
7. Intellectual property
Scholarova and its branding, software, and materials are protected by intellectual property laws. Except for the limited rights expressly granted, we reserve all rights.
8. Third-party services
The Service may link to or integrate third-party services. Those services are governed by their own terms; we are not responsible for third-party services we do not control.
9. Fees
Some features may be free and others paid or subscription-based. If we charge fees, we will present terms at purchase. Unless stated otherwise, fees are non-refundable to the extent permitted by law.
10. Disclaimer
The Service is provided “as is” to the fullest extent permitted by law. We disclaim all warranties whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
Nothing in these Terms limits liability that cannot be limited under applicable law, including death or personal injury caused by negligence or fraud.
Subject to the foregoing, Scholarova shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or business opportunities. Our aggregate liability arising out of the Service shall not exceed the greater of (a) amounts you paid us in the twelve (12) months before the event giving rise to liability, or (b) £100, except where prohibited by law.
12. Indemnity
To the extent permitted by law, you will indemnify and hold harmless Scholarova against claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, misuse of the Service, or breach of these Terms.
13. Termination
You may stop using the Service at any time. We may suspend or terminate access with or without notice where reasonably necessary (for example for breach, security, or legal compliance). Provisions that by their nature should survive will survive termination.
14. Governing law and disputes
These Terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, subject to mandatory consumer protections where applicable.
15. Changes
We may update these Terms. We will post the updated Terms and revise the effective date. For material changes, we will provide notice where required by law. Continued use after changes take effect constitutes acceptance unless applicable law requires additional consent.
